Dear Friends,
I announced at our Feb 16th meeting that I am stepping down as President of the Jefferson County Tea Party to run for County Treasurer. Even though the law states I could continue as President, I felt it would be best to step down and eliminate any perceived conflict of interest. As you already know, the Jefferson County Tea Party as an organization does not endorse candidates, and I believe that policy should never change.

It seems like only yesterday when 2,500 citizens gathered in Arnold Park on a beautiful warm day to rally together to tell our Federal and
local governments that we have had enough of big government tax and spend policies that are bankrupting the country. Our efforts to educate and inform the electorate about the candidates helped bring about unprecedented election results in Jefferson County. The ‘Good Old Boy’ network was thoroughly defeated and candidates supporting Tea Party principles had overwhelming victories. Most of those candidates elected continue to stand strong on Tea Party principles. For those that have not, I expect they will be held accountable when they face the voters for re-election.

Because of your time and donations, we have been able to continue the momentum and keep everyone engaged through our monthly meetings. I am very proud of what we have accomplished the last two years. It has been a privilege for me to serve as President of this movement and I have made some very good friends along the way. I have faith that under Steve Farmer’s leadership, guidance from The Steering Committee, and your continued involvement, the Jefferson County Tea Party will continue to thrive for many years to come.
Thank you, and God Bless America.

Sincerely,
Ken
Horton

Thank you Ken Horton for your dedicated sacrifice over the last 2 years in the start-up of the Jefferson County Tea Party. Without your efforts there would be no Patriot group in Jefferson County or at least not one with the positive impact we have enjoyed. It is your example to all of us of what one person can accomplish if he/she is willing to step up and put country ahead of comfort. It is Patriots like you that put country first in forming and defending our great union from the beginning until now. We have always been under attack from within and except for those who are willing to step up and sacrifice, even life itself, we would not be free today. It is for our future generations we do these things and as it has been said ” All that is necessary for evil to triumph is for good men to do nothing”. We can not thank you enough for all you have done and we do anticipate even greater accomplishments by you in the future, where ever that leads you. We challenge all Patriots to step up like you have and if we do, evil will not triumph but freedom will ring. Thank you Ken Horton.

Today Judge Mark Neill’s ruling in the Alexa Smith et al. v. City of St. Louis case was released. The ruling today upholds a preliminary ruling from May of 2011 and strikes down and renders void the City of St. Louis’s Red Light Camera Ordinance 66868. This was done on 2 points.

1) Count I-That the City of St. Louis’s Ordinance and procedure violate Missouri Constitutional Due Process in that they portend to punish the operator of the vehicle, when in reality, they merely charge the registered owner, while making no attempt to actually identify the vehicle operator. Judge Neill specifically states that this applies to both Civil and Criminal prosecutions.

2) Count VII- perhaps the more clear cut legal point, is that the Red Light Camera Ordinance which the City of St. Louis enacted, is not a “traffic ordinance” under statutory police powers as it “does nothing to regulate or control the streets or traffic”, but rather, is just a new way to enforce the Missouri Statute against violating a “steady red indication,” for which they attach a penalty which is different than that which is prescribed by statute for the violation. While Charter Cities have wider legislative powers, what they do not have is the ability to draft ordinances which conflict with state statute.

Unfortunately, Judge Neill said Alexa would not be getting her $100 back because she “voluntarily” paid, but Judge Neill did tell her that should not prevent her from recouping both compensatory and punitive damages, Attorney’s Fees, and interest, so my guess is, in the end, she will be getting a check for a bit more than $100.

Moral of the story, if you are foolish enough to pay, you do so voluntarily, because the ordinance is void. Consider it your donation to the city.

Will the City of Arnold see the light, or are they going to force a Judge to show them, at tremendous cost to the City residents? Only time will tell…….

Without further adieu, the Friday, Feb 17th Ruling, published today is below:

The current firestorm over the decision by the Obama administration to require religious affiliated institutions, such as schools and universities, and their associated medical insurance providers to provide free birth control, is both predictable and desired by the progressives. It serves several purposes of the administration and is in line with Saul Alinsky tactics. While some are saying that the administration miscalculated the reaction they would get, I disagree.

The first way this serves their purpose is by their overreach on this issue. Even on Fox News, I have heard the term “dial back” on more than one occasion; and that is the meme that the media has taken up, saying that he will “compromise” on his initial declaration, to make the less onerous overreach seem reasonable by comparison. Then, when conservatives and religious leaders react with outrage, as they have, they are tarred and demonized as being “unreasonable” and unwilling to compromise; thus the progressives advance their radical ideas one step at a time while making their critics appear irrationally adamant and inflexible.

The second purpose is to whip up his base and get them stirred up and adamant in their own right over a highly charged and personal issue, while at the same time dividing many conservatives and people of faith. That the administration has also made this a “health care” issue is both smart and disingenuous; again, he reinforces the progressive idea that abortion and birth control are simple health care choices rather than complex moral issues with real consequences for all involved; and propagates this line of thinking to discredit any moral or religious argument, and keep us at each other’s throats, divided and fighting along ideological lines. The class warfare is expanded!

This brings me to the last reason, though there are more that may be explored, as to why I think this administration has chosen this fight at this time: How much are you hearing in the main stream media about the economy or the precarious situation in the EU or Iran? That’s right, it is a good smoke screen and attention diverter. “Pay no attention to the man behind the curtain”, as the Wizard of Oz proclaimed. “There is nothing to see here, move along!”

Do not overestimate the lengths that the progressives will go to advance their agenda nor underestimate the strength of their commitment to their cause. This has been an enduring failing amongst conservatives; the willingness to commit to the fight and recognize that the other side will stop at nothing to achieve their ends. While we are known for our willingness to be reasonable in debating the issues openly, and find compromise where we can; the progressives see this as weakness and exploit it. As Gandhi said: “All compromise is based on give and take, but there can be no give and take on fundamentals. Any compromise on mere fundamentals is a surrender. For it is all give and no take.”

As a former fetus, I am glad that my mother chose to allow me to live, and the ability to be here, in this place, living, breathing, enjoying this life and expressing myself, is about as fundamental as it gets.

That’s right. Ten days. SPREAD THE LINK, PLEASE.

Missouri State Representative Paul Curtman has introduced HB1512, common-sense legislation that protects Missourians’ individual constitutional rights from foreign laws or legal doctrines where the application of those laws/doctrines would violate those constitutional rights. No particular foreign law is singled out. The proposal applies to them all.

This Bill needs our support ASAP! Why? Please read my post, “Urgent: Stop the UN Resolution Convention on the Rights of the Child!”.
Excerpts:

The United States Congress has in the works to ratify this UN Contractin November of this year! Once ratified, the “government would have the right to intercede or supersede if officials believe the parents are doing something that is not in the best interest of the child based on a UN Council.”
The CRC purports to protect children, but would replace fit parents with government bureaucrats and judges as the first line of defense for our kids. In addition, it would take family law authority away from our states and make it an international treaty obligation at the federal level.

This is because under Article VI of the U.S. Constitution, any ratified treaty becomes the supreme law of the land, and the judges in every state are bound by it, regardless of conflicts with federal law or state laws or constitutions.
Cohen and Debenedet cite Reid v. Covert to contend that our concern is false because “no international treaty has the power to override the U.S. Constitution.” But this ignores the fact that parental rights do not appear in the Constitution; they are implied rights found in the Fourteenth Amendment. The Court in Reid v. Covert addressed rights not expressly in the Constitution, such as parental rights, thus: “To the extent that the United States can validly make treaties, the people and the States have delegated their authority to the National Government, and the Tenth Amendment is no barrier” 354 U.S. 1 (1957).

Fortunately, Act For America is aware of this bill and has done an email blast to get people to call/email/etc the Missouri House Judiciary Committee to co-sponsor this bill.

From the email:

There is a large and growing base of support for “American Laws for American Courts” legislation, like HB1209. A variety of interfaith groups, including the American Islamic Leadership Coalition, as well as eight leaders in the national security arena have come out in strong support of American Laws for American Courts legislation.
Brigitte Gabriel and our national staff have made the passage of this bill a top priority for the 2012 legislative session. This is a vital step in the overall protection of the nation. This erosion of Constitutional authority must be stopped.

***Action Item ***
We need you to urge members of the Missouri House Judiciary Committee to co-sponsor HB1512 and to move it through their committee as soon as possible. Please let them know that this bill is of highest priority to you!

Please respectfully relay the following sentiments in your own words in an e-mail.
Tip: Simply copy and paste the legislator’s e-mail address found below into your email BCC slot. In one e-mail you can contact all of committee members.

This bill is of the utmost importance to me!
